Psychological injury evidence
across MIB caseload.

Psychology Experts supports MIB-instructed handlers with the psychological component of untraced drivers, uninsured drivers, Article 75, foreign-drivers and high-value RTA claims. Post-RTA PTSD, complex PTSD, travel phobia, psychological injury quantum, neuropsychological TBI assessment, symptom validity testing and capacity overlay for vulnerable and child claimants — from a specialist panel of Vetted psychologists, held to CPR Part 35 standards.

01 Overview

Where quantum in MIB cases turns on
the psychological picture.

In most MIB claims, the physical injury is documented by an orthopaedic surgeon or pain consultant. The psychological component — PTSD, travel phobia, depression, adjustment disorder, neuropsychological deficit from TBI — is what determines whether the quantum stays at five figures or moves to six. And it’s the psychological evidence that most commonly fails in MIB matters: either it’s absent, it’s produced too late, or it’s produced by a generalist who doesn’t survive cross-examination.

Psychology Experts provides the specialist psychological evidence layer for MIB caseload. Consultant psychologists with documented RTA expertise, chartered clinical psychologists with psychometric capability, neuropsychologists with TBI-specific test batteries, and trauma specialists with experience in the particular presentation profile that serious RTA generates — all under a single case manager, all to CPR Part 35.

“MIB claims fail when the psychological evidence is absent or when it’s produced by a generalist with no RTA-specific experience. Travel phobia, hypervigilance, post-concussion cognitive deficit — these are the factors that move the quantum. We provide the specialist who can evidence them and survive the cross-examination.”

02 Instruction Scope

Eight psychological evidence categories
for MIB caseload.

The psychological evidence that MIB handlers most commonly instruct — each requiring consultant-level opinion from a specialist with documented experience in the specific clinical question that RTA, untraced and uninsured driver claims present.

01

Post-RTA PTSD

Consultant psychological assessment of PTSD following road traffic accident — full diagnostic evaluation, symptom trajectory, treatment response prediction and prognosis. This is the core of psychological evidence that underpins the psychological injury component of most MIB claims above the fast-track threshold.

02

Complex PTSD Following RTA

Where the RTA sits on top of prior trauma history — childhood adversity, prior abuse, previous accident or loss. Complex PTSD (ICD-11) assessment requiring trauma-specialist expertise to separate index injury contribution from background trauma. Material for limitation arguments and quantum where the claimant’s vulnerability amplified the impact.

03

Travel Anxiety & Phobic Avoidance

Specific phobia (travel-related), driving avoidance, passenger anxiety and the functional impact on employment, daily living and social participation. Specific to RTA claims and frequently undervalued when it isn’t properly evidenced. Quantifiable impact on quantum when the prognosis is documented.

04

Neuropsychological Assessment

Neuropsychologist assessment for traumatic brain injury following RTA — concussion sequelae, post-concussion syndrome, cognitive profiling and functional deficit quantification. Standardised test batteries (WAIS, WMS, DKEFS, Trail Making) providing the cognitive evidence that drives TBI care-needs quantum.

05

Psychological Injury Quantum

Condition & prognosis report specifically for settlement and quantum in MIB claims — linking diagnosis, severity, treatment trajectory and prognosis to the Judicial College Guidelines and the claimant’s specific functional impairment. The psychological evidence that supports the quantum schedule.

06

Vulnerable & Child Claimants

Child claimants with capacity considerations and litigation-friend framework, claimants lacking litigation capacity under the Mental Capacity Act 2005, and vulnerable witnesses requiring adapted assessment methodology. COP3, litigation capacity and best-interests evidence available from the same panel.

07

Malingering & Symptom Validity

Objective psychometric assessment of symptom validity and exaggeration using validated instruments. The evidence defendant insurers and MIB handlers need when the psychological presentation is challenged. Quantified, replicable, defensible under Part 35 scrutiny.

08

Pre-Existing Psychological Condition

Where the claimant had a documented psychological history before the index RTA — prior depression, anxiety, previous PTSD, personality vulnerabilities. Separating pre-existing condition from index injury contribution. The evidence-based causation reasoning that withstands cross-examination on apportionment.

Scope clarification

Psychology Experts provides the psychological component of MIB claims. We do not provide orthopaedic, neurology, pain medicine (physical), surgical, radiology or rehabilitation evidence. Where the MIB matter requires both physical and psychological evidence, your existing physical-medical panel or our sister chambers Psychology Experts provides the physical component; we provide the psychological evidence layer.

03 Operational Fit

Aligned with how
MIB handlers work.

01 Specialist depth

RTA-experienced psychologists

Every psychologist allocated to MIB work has documented experience in post-RTA presentations. Not a generalist who happens to be available — a specialist whose RTA expertise and court experience is what the handler is paying for.

02 Psychometric rigour

Objective, quantified evidence

Standardised psychometric testing, validated symptom-validity instruments and quantified cognitive profiling. The objective evidence that moves the psychological opinion from impressionistic to defensible — particularly material in MIB matters where credibility is in issue.

03 Rapid triage

Court-deadline priority

Court-deadline, trial-date and MIB internal timetable constraints flagged at intake. Expert CV and fee quotation within minutes. Expedited allocation for time-critical matters. Diary held against listing from the point it is confirmed.

04 MIB FAQ

Commonly asked
MIB questions

Do you cover the full MIB report or only the psychological component?

Only the psychological component. Orthopaedic, neurology, pain medicine (physical), surgical and radiology evidence is not within our scope. Where both physical and psychological evidence is required, your existing physical-medical panel covers the physical and we provide the psychological layer — or our sister chambers Psychology Experts can provide the full multi-specialty coverage.

Can you provide both a psychologist for the same claim?

Yes — under a single case manager. A common combination for high-value MIB matters is a practitioner psychologist for diagnosis, condition & prognosis alongside a chartered clinical psychologist or neuropsychologist for psychometric assessment and cognitive profiling. Evidence is coordinated to prevent contradiction; the handler works with one point of contact.

How do you handle pre-existing psychological conditions?

Analytically. The pre-existing condition is characterised from the clinical record, its contribution to current presentation is separated from the index RTA’s contribution, and the reasoning is made visible. Where the prior history is complex, the expert acknowledges the complexity rather than oversimplifying. Part 35 scrutiny is the baseline standard for the causation analysis.

Can you provide objective evidence on malingering or exaggeration?

Yes. Forensic clinical psychologists with symptom-validity expertise are available on the panel. Validated instruments (SIMS, TOMM, FBS, M-FAST and equivalents) provide quantified, replicable evidence that withstands Part 35 scrutiny. Particularly material in MIB matters where the defendant challenges the credibility of the psychological presentation.

What about child claimants or claimants who lack capacity?

Child claimant assessments use age-adapted methodology within the litigation-friend framework. Where the claimant lacks litigation capacity under the Mental Capacity Act 2005, COP3 and litigation capacity evidence is available from the same panel. Vulnerability considerations are built into the assessment protocol from intake — not added as an afterthought.

Will the psychologist attend trial?

Yes — in person or by secure video link via the Cloud Video Platform. Trial attendance, joint expert discussions under CPR 35.12, Part 35 question responses under CPR 35.6 and pre-trial conferences with counsel are included within the standard scope. Diary held against the listing from the point it is confirmed.
