What Is an Independent Social Worker?
An Independent Social Worker is a qualified, registered social worker instructed by the parties or the court rather than by a local authority, to give an independent assessment of a family or an adult. Social worker is a title protected by law: in England the register is held by Social Work England, and in Scotland, Wales and Northern Ireland by the SSSC, Social Care Wales and the NISCC.
In family and welfare proceedings, an independent social work assessment answers the questions the court cannot answer from the local authority evidence alone: what a parent can provide, what risk remains, and what realistic options exist for the child. They assess areas including:

When to Instruct an Independent Social Worker
An independent social work assessment is appropriate when parenting, risk, placement or care and support is a central question and the court needs an assessment independent of the local authority. Instruct this expert type when you need:
Parenting Capacity
Establishing what a parent can provide now, what they could provide with support, and within what timescale.
Risk & Safeguarding
Determining the nature and level of risk to a child or adult, and whether it can be safely managed.
Placement Options
Evaluating the realistic options for a child’s care, including kinship, connected persons and special guardianship.
Support Needs
Identifying the support that would be required to make a placement work, and who would provide it.
Contact & Reunification
Assessing contact arrangements and the prospects of safe reunification.
Capacity & Best Interests
Providing social work evidence on care, support and best interests in Court of Protection matters.

Frequently Asked Questions
A Children’s Guardian is appointed by Cafcass or Cafcass Cymru to represent the child and give the court an independent view of the child’s welfare across the whole case. An Independent Social Worker is instructed to answer specific assessment questions the court has identified – a parenting assessment, a viability assessment, a special guardianship assessment. The two roles sit alongside each other; they do not replace one another.
In family proceedings, yes. Expert evidence may only be put before the court with permission under Part 25 of the Family Procedure Rules, and the court must be satisfied the evidence is necessary to resolve the proceedings justly. We can provide a CV, a fee estimate and a proposed timetable in the form needed for the application, before you make it.
Yes. Our children and families social workers cover parenting capacity, kinship, special guardianship and care proceedings. Our adult social workers cover Care Act 2014 assessments, safeguarding enquiries, mental capacity and best interests, and the standard of social work practice where that is in issue.
Yes, where the timetable is set at the outset. A special guardianship or connected persons assessment requires interviews, home visits, checks and analysis, and cutting that short produces an assessment the court cannot rely on. We will tell you honestly what is achievable in the time available before accepting the instruction.
Remote sessions work for parts of an assessment – background interviews, follow-up questions, professional consultations. They do not replace seeing a parent and child together, or seeing the home. For any assessment that turns on observed interaction or the home environment, we assess in person.
A Merton-compliant age assessment is an assessment of a young person’s age carried out to the standards the courts have set, following R (B) v Merton London Borough Council. It requires two assessors, a fair opportunity for the young person to respond to concerns, an appropriate adult, and reasons given for the conclusion. An assessment that does not meet those requirements is open to challenge.
